N.J.S.A. 2A:34-23(n) and the Effect of Cohabitation on Alimony
On September 10, 2014, the New Jersey Legislature amended the alimony statute, N.J.S.A. 2A:34-23.
When determining whether cohabitation is taking place, a court will evaluate the following:
1- Intertwined finances, including joint bank accounts and other shared holdings or liabilities.
2- Joint responsibility for living expenses.
3- Recognition of the relationship within the couple’s social and family circles.
4- Co-habitation, including contact frequency, the relationship's duration, and other indicators of a mutually supportive intimate personal relationship.
5- Shared household chores.
6- Whether the alimony recipient has received an enforceable promise of support from another individual.
7- Any other pertinent evidence.
